Terms of Service

1. Acceptance of Terms

By accessing or using the InRank mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the modified Terms.

2. Description of Service

InRank is a financial analysis platform that provides:

• Stock Analysis: Real-time technical scores, rankings, and comprehensive stock analysis using 40+ analytical strategies
• Market Insights: Daily commentary, market overview, and signal distribution analysis
• Investment Strategies: Access to backtests, trades, top strategies, and value opportunities
• Alerts & Notifications: Custom price and signal alarms for stocks (Premium feature)
• Favorites & Watchlists: Save and track your favorite stocks
• Methodology Tools: Value investing opportunities, QARP/GARP analysis, and multi-method company screening

The App provides financial information and analysis tools for educational and informational purposes only. It does not provide financial advice, investment recommendations, or trading services.

3. User Accounts and Authentication

3.1 Anonymous Usage

You can use the App without creating an account. When you use the App:

• An anonymous account is automatically created for app functionality
• Your preferences (favorites, alarms) are stored and associated with this anonymous account
• This anonymous account is device-based and persists on your device

3.2 Optional Authentication

You may choose to sign in using:

• Google Sign-In
• Apple Sign-In
• Email and password

When you sign in, your preferences from anonymous usage are automatically transferred to your authenticated account. The anonymous account data merges with your authenticated account.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Terms

4.1 Subscription Tiers

Free Tier:

• Access to basic features including stock browsing, limited scores, and market commentary
• Ability to add favorites and use favorites filter
• Access to explore features (read-only)
• View subscription options and purchase premium

Premium Tier:

• All features available in Free tier
• Full technical scores and rankings
• Access to all 40+ strategies, backtests, and trades
• Value opportunities and methodology tools
• Alarms and notifications
• Advanced analytics and historical data
• Market commentary in Market Report sections

4.2 Subscription Management

• Subscriptions are managed through RevenueCat and processed via Apple App Store or Google Play Store
• Subscriptions are device-based and tied to your device
• Subscription status is checked automatically when you use the App
• You can manage or cancel your subscription through the Account screen or directly through the App Store/Play Store

4.3 Subscription Billing and Auto-Renewal

• Subscription fees are charged through your Apple App Store or Google Play Store account
• Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period
• You will be charged for renewal within 24 hours prior to the end of the current period
• The renewal price will be the same as the original subscription price, unless we notify you of a price change in advance
• You can manage subscriptions and turn off auto-renewal at any time in your device's App Store or Play Store settings, or through the Account screen in the App
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.4 Subscription Cancellation

• You may cancel your subscription at any time through the Account screen or your device's App Store/Play Store settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to Premium features until the end of the current billing period
• No refunds are provided for partial subscription periods

4.5 Subscription Refunds

• Refund requests must be processed through Apple App Store or Google Play Store
• We do not process refunds directly
• Refund policies are subject to Apple's and Google's respective refund policies

5. Premium Features

Premium features require an active subscription. Access to premium features may be restricted if:

• Your subscription expires
• Your subscription is cancelled
• Payment fails and subscription is not renewed

When your subscription expires, you will automatically revert to Free tier access. Your user data (favorites, preferences) will be retained.

6. User Responsibilities

6.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App without permission
• Interfere with or disrupt the App's operation
• Share your account credentials with others

6.2 User Content

You are responsible for any content you create or share through the App (such as favorites, alarms, preferences). You agree that:

• You have the right to create and share such content
• Your content does not violate any third-party rights
• Your content complies with applicable laws

7. Intellectual Property

7.1 Our Rights

The App, including its design, features, content, and functionality, is owned by InRank and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the App
• Use our trademarks or logos without permission
• Remove any copyright or proprietary notices

7.2 Your Rights

You retain ownership of any content you create through the App. By using the App, you grant us a license to use, store, and process your content as necessary to provide the App's services.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at https://www.inrank.app/privacy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

• We use Firebase for authentication and cloud services
• We use RevenueCat for subscription management
• Your preferences and favorites are stored securely
• We do not sell or rent your personal data

You acknowledge that:

• Uninterrupted or error-free operation
• Availability at all times
• Accuracy of all data or calculations
• Compatibility with all devices or operating systems

You agree to indemnify and hold harmless InRank, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or share through the App

12. Termination

12.1 By You

You may stop using the App at any time by uninstalling it from your device.

12.2 By Us

We may suspend or terminate your access to the App if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the App or service

Upon termination, your right to use the App will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the “Last Updated” date at the top of these Terms
• Posting a notice in the App (if significant changes occur)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InRank operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiation
2. If negotiation fails, through binding arbitration in accordance with applicable arbitration rules
3. You waive any right to participate in class action lawsuits

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InRank regarding the App and supersede all prior agreements and understandings.
